CHAPTER 11

THE RIGHT TO COUNSEL

STUDY QUESTIONS AND WRITING PROMPTS

When you read the account of Clarence's first trial (pages 101-102) did you believe he was guilty?

Did his history of convictions made you more likely to think he was guilty?

Compare the two trials, one on page 101-102, and the second on pages 104-105. Why do you think Clarence's lawyer, W. Fred Turner, could do a better job?

Do you agree with the Supreme Court that the Fourteenth Amendment (requiring due process of law and equal protection of the laws) requires the government to provide lawyers for people who cannot afford them?
